You may not use the service for unlawful, infringing, abusive, deceptive, or harmful activities, including uploading content that violates the rights of others.
We may suspend or terminate access if we reasonably believe the service is being misused or used in a way that creates legal or operational risk.
4. Service Scope and Outputs
FixMyPhoto is a photo restoration and enhancement service for user-provided images. The service is designed to improve, repair, upscale, colorize, brighten, sharpen, or extend uploaded photos.
It is not offered as an open-ended text-to-image generation product, and results can vary depending on scan quality, physical damage, and source material.
You understand that outputs are processed with automated tools and may require your review before final use, printing, publication, or archival distribution.
5. Billing and Payments
Paid features may require one-time or recurring payments. Applicable pricing will be shown before checkout.
Payments are processed by Creem as Merchant of Record where indicated at checkout.
Unless otherwise stated at checkout, fees are non-refundable once processing or delivery has begun, except where required by law.
We may change future pricing, plan structure, or included allowances, but any changes will apply prospectively rather than retroactively.
6. Intellectual Property and Uploaded Content
As between you and FixMyPhoto, you retain ownership of the content you upload, subject to the rights needed for us to operate the service.
You represent and warrant that you have the necessary rights, licenses, and permissions to upload and process any image submitted to the service.
You grant us a limited license to host, process, reproduce, and transform uploaded files solely for the purpose of providing the restoration service and related support operations.
7. Indemnity
You agree to defend, indemnify, and hold harmless FixMyPhoto from claims, damages, liabilities, and expenses arising out of your uploaded content, misuse of the service, or violation of these terms, to the extent permitted by law.
This allocation helps ensure that unlawful or unauthorized uploads remain the responsibility of the user who submitted them.
8. Disclaimers and Limitation of Liability
The service is provided on an “as is” and “as available” basis to the fullest extent permitted by applicable law.
We do not guarantee uninterrupted availability, error-free operation, or that every restoration result will meet your expectations for every image.
To the maximum extent permitted by law, FixMyPhoto will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
9. Governing Law and Disputes
These terms are governed by the laws that apply in the operator's principal place of business, unless mandatory consumer protection law in your jurisdiction requires otherwise.
If a dispute cannot be resolved informally, the parties agree to use the courts or other dispute forums that are legally competent under the applicable law and contract terms.
